These terms govern use of Train TRACK and its related services. By using the service, you agree to these terms. Apple's applicable terms also govern App Store purchases and app distribution. Apple’s standard app license applies to the iOS app; these service terms do not replace it.
Crossing information and safe use
Train TRACK provides railroad-crossing information based on available data and user reports. Information can be incomplete, delayed, stale, conflicting or incorrect. A reported Clear status is not permission to cross. The app does not guarantee that a crossing is clear, open or safe, predict every train, or guarantee a route or arrival time. Missing reports do not mean a crossing is clear.
Always obey signs, lights, signals, gates, railway rules and applicable law. Check actual conditions. Never go around a lowered gate or rely on this app in place of safe judgment. Do not operate the app while driving in an unsafe manner. Stop safely before submitting reports or playing Eggs-Press. The service is not an emergency-reporting channel.
Train TRACK serves a general audience and is not specifically directed to children. Initial App Store availability is intended for the United States.
Accounts and reports
Use account information you are authorized to use and protect access to your account. Do not impersonate another person, interfere with the service, evade safeguards, manipulate ad measurements or game scores, or use the service unlawfully.
Submit crossing reports only from your own observations when it is safe to do so. Reporting and confirmations require proximity to the selected crossing, approximately one-quarter mile. Do not submit false, abusive or misleading reports. Connectivity, location permission and other checks can prevent a report from being accepted.
You retain rights you hold in content you provide. You grant Withamedia LLC permission to host, process, display and distribute that content as needed to operate, secure and moderate Train TRACK. Crossing evidence can remain after the identifying account association is removed. Do not submit content that violates another person's privacy or rights. Public leaderboard names must be appropriate; names can be reported or hidden using the leaderboard controls. We may remove content or restrict misuse subject to applicable law.
Train TRACK Plus
The U.S. subscription options are $1.99 per month or $19.99 per year, with no free trial. Apple's purchase sheet shows the applicable storefront price and terms before confirmation.
Plus includes proactive blockage alerts for followed crossings, removal of display ads on Map/Home and My Crossings, and one free Eggs-Press bonus egg per run without watching a video. Game scenery billboards remain visible. Alerts require applicable preferences/permissions and service availability; delivery is not guaranteed.
Payment is charged through your Apple Account at purchase confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends; Apple charges renewal within 24 hours before that period ends. Manage or cancel through Apple subscription settings. Cancelling renewal generally leaves access available through the paid period, subject to Apple's processing, refunds or revocation. Refund requests are handled through Apple under applicable rules and law.
Use Account → Plus → Restore Purchases to restore an eligible Apple purchase. Purchase ownership and the Train TRACK sign-in account must be consistent; contact support if account access prevents restoration. Uninstalling the app, signing out or deleting Train TRACK data does not cancel the Apple subscription. No cancellation step is a prerequisite to requesting immediate account deletion.
Ads and Eggs-Press
Local ads may include links to advertisers' websites, calling or directions. Advertisers are responsible for their own offers; an ad is not our guarantee or endorsement. Third-party destinations have separate terms.
Watching a local sponsor video is optional. A completed eligible video can grant one extra egg in the current run. Availability varies; interrupted or incomplete playback may not grant a reward. Plus provides its included bonus without a video. Virtual eggs and scores have no cash value; the game offers no wagering or cash prizes.
Intellectual property
The app's software, branding and original materials belong to their respective owners. These terms grant use of the service, not ownership of those materials. Third-party software and map data remain subject to their applicable licenses and attribution requirements. Do not remove displayed attribution.
Availability and account deletion
Features depend on connectivity, device permissions, external providers and available reports. Service interruptions or changes may occur. We may suspend access for misuse or to protect the service, subject to applicable law and any rights relating to paid services.
Normal and guest accounts can request deletion through Account → Delete account. The account deletion page explains what is removed and retained. Advertisers may delete their personal login through Account → Delete account in the portal or app. Business, campaign, creative and accounting records remain under system custody for legitimate business, security, audit and service-integrity purposes. Active campaigns may continue under administrator control; deleting a login does not automatically cancel or refund an advertising purchase. Administrators must transfer control to another established administrator and have their administrator role removed first. Ending app access does not automatically terminate Apple's billing relationship.
Disclaimers and responsibility
To the extent permitted by applicable law, Train TRACK is provided as available without a promise of uninterrupted operation, complete or accurate crossing information, or successful notification delivery. Do not rely on it as a safety system.
To the extent permitted by law, Withamedia LLC is not responsible for losses caused by reliance on inaccurate or delayed reports, unavailable notifications, or third-party services beyond its control. This clause does not exclude liability that cannot lawfully be excluded or limit mandatory consumer rights.
